1. Acceptance of Terms

By accessing or using FitScore, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, do not use the platform.

2. Service Description

FitScore is a SaaS platform for personal trainers, offering tools for student management, physical assessments, biomechanical analysis, workout prescription with artificial intelligence, periodization, nutrition, scheduling, payments and gamification.

3. Eligibility

• You must be at least 18 years old to create a trainer account.
• Trainers must hold a valid professional registration (CREF) and are solely responsible for the technical content delivered to their students.
• Students under 18 years old may only be registered with the express consent of a legal guardian.

4. Account and Security

• You are responsible for keeping your access credentials confidential.
• You must immediately notify us of any unauthorized use of your account.
• We reserve the right to suspend or cancel accounts that violate these terms.

5. Subscription Plans and Payment

• FitScore offers Free, Pro and Premium plans, with a 14-day Pro trial period.
• Subscriptions are recurring and processed through MercadoPago. By subscribing, you authorize the periodic charging of the contracted amount.
• You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing cycle.
• Refunds follow Brazilian consumer law: 7-day right of withdrawal for distance purchases.

7. Acceptable Use

You agree not to:

• Use the platform for illegal purposes or those that violate third-party rights.
• Send false, misleading or offensive content.
• Attempt to access areas of the system without authorization, including reverse engineering, scraping or vulnerability exploitation.
• Share access to your account with third parties.
• Use the platform to spam, distribute malware or interfere with other users.

8. Intellectual Property

All content of the FitScore platform — including software, brand, design, biomechanical algorithms, AI models and documentation — is the exclusive property of FitScore or its licensors and is protected by intellectual property laws.

Content created by you (training plans, evaluations, materials) remains your property. You grant FitScore a limited license to host and process this content for the purpose of providing the service.

9. Artificial Intelligence

The platform uses AI providers (OpenAI, Google, Anthropic) to generate suggestions, analyses and texts. The outputs are probabilistic and may contain errors. The trainer is solely responsible for technical validation before applying any recommendation to students.

10. Liability Limitation

FitScore is not liable for indirect, incidental or consequential damages arising from the use of the platform, including loss of profits, data loss or interruption of business activities, except in cases of willful misconduct or gross negligence.

11. Termination

You may close your account at any time through the platform settings. We may suspend or terminate accounts that violate these terms, with prior notice when possible.

12. Changes to the Terms

We may update these Terms of Use periodically. Material changes will be communicated through the platform or by email. The continued use of the service after the changes constitutes acceptance of the new terms.

13. Applicable Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any dispute will be resolved in the court of the user's domicile, in accordance with the Consumer Protection Code.
